Terms and Conditions
THESE TERMS & CONDITIONS (“Agreement”, “Terms” or “Policy”) GOVERN YOUR ACQUISITION AND USE OF SOFTWARE AND SERVICES PROVIDED BY ADROIT ACCOUNTING SOFTWARE CC (“Adroit”), INCLUDING ALL MY T-ACCOUNTS SOFTWARE PROGRAMS. BY ACCEPTING THIS AGREEMENT, EITHER BY CHECKING A BOX INDICATING YOUR ACCEPTANCE OR BY PLACING AN ORDER THAT REFERENCES THIS AGREEMENT, YOU AGREE TO THE TERMS OF THIS AGREEMENT.
END-USER LISENCE AGREEMENT (EULA)
This EULA (End-User License Agreement) is a legal agreement between you (either an individual or a business entity) (“YOU”) and Adroit Accounting Software CC (“Adroit”) and should be read carefully. The terms and conditions contained within this document apply to the My T-Accounts program (the “SOFTWARE”) accompanying the agreement. If you do not agree to these terms, do not buy, install, register, or activate the software. By purchasing the program, you fully agree to be bound to these terms and conditions.
GRANT OF LICENSE
The SOFTWARE is licensed, not sold. Adroit grants to YOU a personal, nonexclusive, non-transferable license to install and use the SOFTWARE for which the applicable annual license fees have been paid.
TERMS OF USE: The SOFTWARE may only be installed, registered and activated on a single computer.
COPY RESTRICTION: Adroit authorizes YOU to make only one copy of the SOFTWARE for backup and archiving, provided that YOU reproduce all copyright notices and proprietary legends.
TRANSFER RESTRICTION: YOU do not have the right to give a copy of the SOFTWARE to another person, electronically or by any other means. YOU may not rent, lease, reverse engineer, decompile, disassemble, translate, merge, or create derivative works from the SOFTWARE.
MANDATORY REGISTRATION: After installation, YOU are required to register and activate your program. Upon registration, YOU will be provided with an activation code as well as a modules code. The activation code is used to activate your program. If YOU have purchased the Premium version of Bank Account Manager, the modules code is used to activate the additional functionality. Adroit retains the right to request proof of payment prior to providing YOU with registration information.
TITLE AND COPYRIGHT: All rights title and interest in the SOFTWARE are owned by and shall remain in Adroit. YOU will not do anything to contest or prejudice Adroit’s title to the intellectual property rights in the SOFTWARE.
INDEMNITY: The SOFTWARE is provided “as is” without any guarantees or warranty of any kind. In connection with the software, Adroit makes no warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, of title, or of non-infringement of third-party rights. Use of the software by a user is at the user’s risk and is deemed acceptance of these terms. IN NO EVENT WILL ADROIT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR OTHER DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL OR BUSINESS INTERRUPTION) EVEN IF ADROIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANOTHER PARTY.
TERMINATION: This EULA is effective until terminated. This EULA will terminate with a notice from Adroit if you fail to comply with any provision of this EULA. Upon termination, you shall destroy all copies of the SOFTWARE previously licensed to you.
OTHER: Microsoft ®, Windows ®, and Access ™ are either registered trademarks or trademarks of Microsoft Corporation in the United States and/or other countries.
REFUND POLICY
We can’t test our programs on every platform and every configuration it may encounter. Therefore if your computer complies with the minimum requirements as set out in our Systems Requirements Policy (see below) and our support staff is unable to get our software up and running on your computer within 21 days after purchase, we will happily give you a refund of 96% of what you have paid, retaining a 4% administration fee before activation and registration of the program.
You will need to provide us with full access to your computer for us to fully debug and install the software. If you cannot provide us this access in a timely and cooperative manner, then we will not be able to give you a refund. (Please refer to our support policy for further information)
You do not qualify for a refund under the following circumstances:
- After you have downloaded and installed our program, you need to register and activate your license. Once registered and activated no refund will be given as the program will be fully functional on your computer.
- You’ve changed your mind or have decided that our program is not what you need or what you thought.
- You’ve found a better or more suitable program after you have purchased our program
- Our program stopped working due to modifications to your computer
UPDATES TO THIS POLICY: This refund policy can be updated at any time, without prior notice and is applicable immediately and retroactively for all subscriptions and subscribers.
ACCEPTANCE OF THIS POLICY: Our refund policy is considered an integral part of our Terms of Use and as such acceptance of this policy is mandatory for all users. It is your responsibility to familiarize yourself with this refund policy. By purchasing any of our programs, you indicate that you have read and understood the policy and that you agree to these terms. If you do not agree, we ask that you do not purchase programs from us.
SYSTEM REQUIREMENTS POLICY
Our program is powered by Microsoft Access. To run successfully you will need either a fully licensed, working version of Microsoft Access 2010 or later, or the free runtime version of Microsoft Access 2010 or later. When installing our program, you will be informed if you do not have Microsoft Access 2010 or later and will be given the option to download for free.
If after purchasing the software it is discovered that you either have an unlicensed version of MS Access on your computer or there are other issues with your MS Access and we are no able to install the runtime version successfully, you will need to have the licensing and other issues resolved, after which we will gladly assist you to get the program up and running.
Technical specifications for a computer or laptop to successfully run the program is determined by the technical specifications required to run the applicable version of Microsoft Access being used.
SUPPORT POLICY
We are available for technical support via WhatsApp and email. We will reply within one working day. Should we require to speak to you in person or access your computer for technical support, this will take place on Saturdays only.
We do not give bookkeeping or accounting support.
We retain the right to charge for non-technical, data- or bookkeeping-related support at our own discretion.
